Terms of use
These terms and conditions (“Agreement”) set forth the general terms and conditions of your use of the https://mcges.gov.jm websites (“Jamaica National Sport Registry”, “Sport Registry”, “Site”.) and any of its related products and services (collectively, “Services”). This Agreement is legally binding between you (“User”, “you” or “your”) and the Ministry of Culture, Gender, Entertainment and Sport (hereinafter known as “MCGES”, “the Ministry” “we”, “us” or “our”).
If you are entering into this Agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this Agreement, in which case the terms “User”, “you” or “your” shall refer to such entity. If you do not have such authority or do not agree with the terms of this Agreement, you must not accept this Agreement and may not access and use the Sport Registry.
By accessing and using the Sport Registry, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement, (as modified from time to time). You acknowledge that this Agreement is a contract between you and MCGES, even though it is electronic and is not physically signed by you, and it governs your use of the Website and Services.
Please note that we may change the terms and conditions from time to time without notice, so you should review the terms each time you visit the site.
1. Children’s Personal Information
Other than information required to register on the Sport Registry, the Ministry does not knowingly collect personally identifiable information from children under the age of thirteen (13). If a child under thirteen (13) provides personal information without parental or guardian consent, the parent or guardian may contact us by emailing us at sportregistry@mcges.gov.jm. We will remove the information and de-register the child from the Sport Registry.
We are required by law, to ask children under the age of eighteen (18) for consent from their parents or guardians before the minor can register on the Sport Registry.
2. Accounts and Membership
You must be thirteen (13) years of age at the time of your use of the Sport Registry. By using the Sport Registry and by agreeing to this Agreement you warrant and represent that you are a minimum of thirteen (13) years of age.
If a user is under eighteen (18) years old, parental consent is required. Once the user is determined to be minor by way of date of birth, a prompt which state that the parent’s consent is required for the collection, use, or disclosure of such information on the Sport Registry, and the we will not collect, use, or disclose any personal information from the child if the parent does not provide such consent.
The user will be asked to provide the parent’s (guardian) online contact information. It will state that the Ministry has collected the user’s and the parent’s online contact information from the child to obtain the parent’s consent.
An email with a hyperlink will be sent to the parent (guardian) wherewith the Ministry’s Privacy Policy and the Terms of Use Policy can be accessed to provide verifiable consent to the collection, use, and disclosure of the information on the Sport Registry.
If the parent does not provide consent within five (5) days from the date the direct notice was sent, the parent’s online contact information as well as any information provided by the minor will be deleted from the Sport Registry.
You must provide a valid email address when registering for this site. If you provide an email address to us, then you warrant to us that you are entitled to receive an email to such email address. You also acknowledge and agree that we may stop sending emails to you without prior notification.
If you create an account on the Sport Registry, it is your responsibility to provide accurate and complete registration details and to keep such details up to date. We are entitled to rely on any such registration details you provide to us. You are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it. Providing false contact information of any kind may result in the termination of your account. You must immediately notify us of any unauthorized use of your account or any other breaches of security.
We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill. If we delete your account for the foregoing reasons, you may not re-register for our Services without our prior written consent.
We reserve the right to withdraw or amend the service we provide on the site or any part of the site without notice. We will not be liable or responsible if for any reason the site is unavailable at any time or for any period.
3. Personal Information
In addition to these Terms and Conditions, you are advised to read the Privacy Policy carefully as it governs our collection and use of information about you and states that we may collect your information and transfer it to institutions as necessary to fulfil the aim of the Sport Registry. By using our Site, you consent to us obtaining and holding your data as set out in the Privacy Policy.
4. Linking
Where the Site and/or applications contain links to other websites, webpages, resources, or mobile services which are proprietary to third parties, other users, advertisers or sponsors, such websites, webpages, resources, and mobile services are provided for your information only and you access them at your own risk. We are not liable or responsible for the content or operation of third-party websites, webpages, resources, or mobile services. You should read any applicable terms and conditions and privacy policies.
5. Third-Party Content
We are not liable or responsible for any third-party content on the Site. Third-party content includes, for example, comments, blogs, and articles posted by any other third parties, Content, the content of advertisements, applications posted by other third parties and content accessed through applications.
6. Termination
You may terminate your use of any of the Services, or access to any part of this Website for which registration is required, at any time by requesting that the Ministry delete your username and password for the relevant service on the Sport Registry.
The Ministry may terminate your right to use the Services or access to any part of the Sport Registry for which registration is required by giving you one (1) month’s notice, or immediately without notice if you breach any of the Sport Registry’s Terms of Use.
Any termination of your right to use any of the Services, or access to any part of the Sport Registry for which registration is required, will not affect any rights or obligations which have accrued by either you or the Ministry and /or the Sport Registry.
7. Prohibited Uses
In addition to other terms as set forth in this Agreement, you are prohibited from using the Sport Registry: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any laws, rules, or ordinances of Jamaica; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Sport Registry, third party products and services, or the Internet; (h) to spam, phish, pharm, pretext, spider, crawl, or scrape; (i) for any obscene or immoral purpose; or (j) to interfere with or circumvent the security features of the Sport Registry, third party products and services, or the Internet. We reserve the right to terminate your use of the Sport Registry for violating any of the above-mentioned prohibited uses or any other illegal illicit use identified.
8. Intellectual Property Rights
For the avoidance of doubt, we are the owner or the licensee of all intellectual property rights in our Site. All such rights are reserved.
We acknowledge and agree that you retain ownership in any copyright you may have in the Content you submit or upload to the Site.
We respect the intellectual property rights of others, and we request that our visitors do the same.
9. Dispute Resolution
The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the laws of Jamaica. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in Jamaica, and you hereby submit to the personal jurisdiction of such courts.
10. Liability
We are not liable for any damages resulting from the use of the information on our Site.
This clause set out our entire financial liability (including any liability for the acts or omissions of our employees, agents and sub-contractors) to you in respect of all losses, claims or liabilities arising under or in connection with these Terms or your use of the Site generally, whether in contract, tort (including negligence), breach of statutory duty, or otherwise.
The information and material contained on the Site is for information purposes only and does not constitute advice. We make no representations or warranties with respect to the Site or its content. All warranties (express or implied) (including without limitation the implied warranties of satisfactory quality and fitness for purpose relating to the Site and/or its content) are hereby excluded to the fullest extent permitted by law. No representations or warranties are given as to the accuracy or completeness of the information or material provided on the Site or any website or webpage to which it is linked.
To the fullest extent permitted by law, we hereby expressly exclude any liability for loss of or corruption to data; loss of profit; loss of anticipated savings; loss of anticipated revenue; loss of business; loss of opportunity; or adverse effect on reputation and/or goodwill.
Without prejudice to the generality of the exclusions of liability contained in this clause, we shall not be liable to you if you cannot access the Site properly or at all (wholly or partly) or if some of its features are unavailable to you due to events outside our control (which shall include without limitation the performance of any internet service provider, the performance of any internet browser or limitations of the device you use to access the Site).
We shall have no liability to you for any loss or inconvenience suffered due to the unavailability or withdrawal of any Content, material, or other information from the Site.
Whilst we monitor the Site with a view to locating and fixing defects, you acknowledge and agree that we cannot guarantee that the Site or any individual feature of the Site will be error-free, be available at all times and/or be free from viruses and defects.
11. Changes and Amendments
We reserve the right to modify this Agreement or its terms related to the Sport Registry at any time at our discretion. When we make any modification(s), we will revise the updated date at the bottom of this page. While we may also provide notice to you using other media or methods at our discretion.
An updated version of this Agreement will be effective immediately upon the posting of the revised Agreement unless otherwise specified. Your continued use of the Sport Registry after the effective date of the revised Agreement (or such other act specified at that time) will constitute your consent to those changes.
12. Site Maintenance
By using the site, you hereby acknowledge and agree that from time to time we may need to fix defects and errors in the Site; install updates and undertake general diagnosis and maintenance of the Site; and undertake emergency maintenance and/or suspend access to the servers and that as a result of which the Site may be less accessible or unavailable to you from time to time.
13. Acceptance of these terms
You acknowledge that you have read this Agreement and agree to all its terms and conditions. By accessing and using the Sport Registry you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to access or use the Website and Services.
14. Severance
If any court or competent authority finds that any provision of these Terms (or part of any provision) is invalid, illegal, or unenforceable, that provision or part-provision shall, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of these Terms shall not be affected.
15. Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of Jamaica.
The courts of Jamaica shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms or its subject matter or formation (including non-contractual disputes or claims).
